196 Why as of April, 28, 2024 it’s Hard to Imagine Trump not Escaping Justice

Geroge Conway has a far more optimistic take, indeed he argues that “everyone should calm down”

George Conway Explains: Everyone needs to CALM DOWN about SCOTUS argument (youtube.com)

but in the course of his video I struggle to figure out the basis of him being so sanguine. Does he as a long time conservative retain a credulous belief in the sanctity of the Supreme Court? He seems to argue that the fact that the conservative justices spend almost no time on the actual issue before them-the specific conduct Trump is being tried for-is somehow a feature not a bug? Or that they’re trying to figure out the contours of finding a ruling that sets the right precedent and that’s why their reasoning was so abstract?

Again I wish I could say I found it reassuring. Conway doesn’t think any Justice on this level would agree with Trump’s self evidently absurd assertion of absolute immunity. Even here it’s not at all clear that is the case, alas, I tend to think Elie Mystal’s prediction is the most plausible: a 7-2 decision to basically send it back-likely waiting until July to render the decision, effectively making a ruling against Trump before the election impossible-the two being Clarence Thomas and Samuel Alito.

They can’t literally make Trump immunity but they are clearly creating a large carveout of conduct that is-they’ve already normalized the idea that Trump DOES have absolute immunity for any “official” conduct which they no doubt will construe as broadly as they can
