Julius Kirmse Property

Julius Kirmse purchased his first property of 40 acres from John B Foster and Joana E Foster for $105 on 7 February 1859. This is the first record that we have of Julius after he disembarked from the bark Kosmos in New York.

Know all men by these presents that we John B Foster and Joana E Foster the wife of the said John B Foster in the State of Missouri have this day for and in consideration of the sum of one hundred and five dollars to the said John B foster in hand paid by Julius Kirmse of the County of Perry and the State of Missouri granted bargained and sold and by these presents do grant bargain and sell unto the said Julius Kirmse the following described tracks or partials of land situate in the County of Perry in the State of Missouri that is to say the North East quarter of the North East quarter of Section Twenty Two In Township Thirty Five North of Range Twelve East in the District of lands subject to sale at Jackson Missouri containing forty acres. To have and to hold the premises hereby conveyed with all the rights privileges and appurtenances there to belonging or in any wise appertaining unto the said Julius Kirmse his heirs and assigns forever, I the said John B. Foster hereby covenanting to and with the said Julius Kirmse his heirs and assigns for himself his heirs executors and administrators to warrant and defend the title to the premises hereby conveyed against the claim of every person whatsoever, In witness where of we have here to subscribed our names and affixed our seals this seventh day of February 1859

Be it remembered that John B Foster and Joana E his wife who are personally known to the undersigned a justice of the peace within and for the said County to be the persons whose names are subscribed to the written Deed as parties there to this day appeared before me and acknowledge that they executed and delivered the same as their voluntary act and deed for the uses and purposes therein contained and the said Joane E being by me made acquainted with the contents of said deed acknowledged on an examination apart from her said husband that she executed the same and relinquishes her dower in the real estate mentioned freely and and without compulsion or undue influence of her said husband

Property description: “the North East quarter of the North East quarter of Section Twenty Two In the Township Thirty Five North of Range Twelve East … containing forty acres”.

Notes

  1. The first name of John Foster’s wife is spelled Joana, Joanh, and  Joane. In the 1860 US Census, her name is given as Joanna age 20 and there are three children (George age 5, Mary age 4 and Willie age 2) in the home.
  2. The date of this land purchase was one day after Julius’s 24th birthday.
  3. In 1865, John Foster and wife sell to Julius Kirmse another 40 acres that is adjoining the present property.
  4. This property is known in the family as the “front 40 of the homeplace”.
